Welcome to 99Peaks! These Terms and Conditions ("Terms") outline the rules for using the 99 Peaks application ("App"), developed by 99 Peaks Pte Ltd, Singapore. By accessing or using the App, you agree to comply with these Terms. If you do not agree, please do not use the App.

99 Peaks provides a holistic wellness platform to enhance physical, mental, emotional, and social health through habit formation, marker tracking, and gamified wellness practices. It contains evidence based informational content related to the peaks and markers along with progress reports of how users conquer different peaks and self checks the markers. Key features of our app includes:

• Peaks: The App provides information on 99 healthy lifestyle habits ("Peaks") that need to be performed on a weekly basis. Users can check-in on these Peaks and earn badges and streaks upon completion.
• Health Marker Tracking: Users can enter and monitor a curated selection of important health markers. The App provides contextual insights based on user input of their health markers and allows users to self-evaluate some of these markers.
• Progress: Users can monitor their Peak Score, which is the sum of all individual peaks’ score (0.5 - 10) that have been conquered, as well as their Marker Score, which is a % calculated using a points system where markers within the “Optimal” range get 20 points, “Acceptable” range 10 points, and within “Caution” or “Missing” 0 points.
• Social Features: The App allows users to refer the app to their friends/family and rate the app on Appstore
• Gamification: Users earn streaks for every week they’ve completed the minimum number of repetitions for each Peak, and earn badges every time those streaks hit new milestones or “Levels”. In case they are unable to submit their weekly wrap up or “Log” before the cut-off time which is set on Mondays at 12:00 PM, they lose their entire progress of conquered peaks and earned streaks. Users then start over with their Peaks journey.

You must be at least 18 years old or the age of majority in your jurisdiction to use the App. By creating an account, you confirm that you are 18+, and we may take steps to verify age eligibility if required by law or platform policies.

• Creating an account may be required to access certain features.
• You are responsible for safeguarding your account credentials that are not to be shared with others.
• Immediately notify us of any unauthorized use of your account, data mining or usage of bot, as it is strictly prohibited.

The App provides informational content only and does not constitute professional medical advice, diagnosis, or treatment. Always consult your healthcare provider before making changes to your health practices. We do not claim to treat, prevent or cure diseases.

You may have access to the full features for the first two months, if you are a Beta user. We reserve the right to determine eligibility for free access, which may vary based on factors including the Product or Service you select and whether you have redeemed a Free Access previously.

Users may access the Products or Services via a subscription fee-based program (“Subscription”). Subscriptions may be available via monthly or annual options (“Subscription Term”). For the purposes of our monthly and annual subscriptions, a month constitutes 30 calendar days and a year constitutes 365 calendar days. Subscriptions may be charged separately for Products and Services. If you activate a Subscription, you authorize 99 Peaks to periodically charge, on a going-forward basis all accrued sums (“Subscription Fee”) on or before the payment due date for the accrued sums. Your account will be charged automatically on the date when you purchase your first subscription to the Product or Service (“Subscription Billing Date”) for all applicable fees and taxes for the next subscription period. The Subscription will continue unless and until you cancel your Subscription or 99 Peaks terminates your Subscription or your account.

• Promotional prices for the app may vary depending on the offers/promotions ongoing.
• For any changes in the pricing, users must check terms and conditions periodically.
• Purchases on the app are final; no refunds for partial periods usage
• Cancel anytime via your Apple App Store account settings.
• Payments are processed through the Apple App Store, and you must comply with their terms and policies when making purchases.

• Use the App lawfully and ethically.
• Commercial use or account sharing is prohibited without explicit consent.
• Follow community guidelines for all interactive features.

All content, designs, text, graphics, and software in the App are the intellectual property of 99 Peaks Pte Ltd. Unauthorized use, copying, or distribution is prohibited.

We collect only necessary data related to user profile and committed towards encryption, obfuscation, anonymization, and de-identification of user data. 99 Peaks ensures that overseas service providers like AWS act only as data processors.

We are committed to provide accurate, evidence-based, reliable information with rigorous fact-checking and quality assurance, but do not guarantee completeness or full accuracy. Use content at your discretion.

The App may include links to third-party sites. We are not responsible for third-party content or services.

We reserve the right to suspend or terminate your App access at any time for violations of these Terms or legal non-compliance.

• We are not liable for any indirect, consequential, or special damages arising from App usage.
• You agree to indemnify 99 Peaks against claims arising from your misuse of the App.

• Disputes should first be resolved through informal negotiation.
• If unresolved, disputes will proceed to binding arbitration in Singapore under Singapore law.

These Terms may be updated periodically and users will be notified via email and in-app notifications. Continued use of the App after changes signifies acceptance.
